Dwyer v. City of Ann Arbor, 79 Mich.App. 113, 261 N.W.2d 231, 8 Envtl. L. Rep. 20,229 (Mich.App., Oct 11, 1977) (NO. 77-1086, 77-1352, 77-1353, 77-1354)

Defendant, City of Ann Arbor, appeals an injunctive order of the trial court, prohibiting the city from issuing any building permits. That order was predicated upon the trial court's finding that the city's sewage treatment facility was polluting the environment, in violation of the Michigan Environmental Protection Act of 1970. The remaining defendants appeal a contemporaneously issued order, restraining them from using certain real property for other than construction of single-family residences. A finding that the property was subject to a reciprocal negative easement formed the basis of that order.
